By submitting your content, comments, text, pictures and graphics (“User Submissions”), you agree to the following:

(a) User Submissions will be considered non-confidential and non-proprietary. YMCA has no obligations with respect to User Submissions. You warrant that your User Submissions are original to you and you own or otherwise control all rights in and to such User Submissions. Any User Submissions containing pictures or material of a third party must have written consent from such third party rights holder (or such person’s parent or legal guardian if a minor) and such material shall not be confidential information. You warrant that User Submissions do not infringe or violate the rights of any third party including trade-mark, copyright, right of publicity, personality or other intellectual property rights. You further warrant that you have the written consent, release, and/or permission of each identifiable individual (or such person’s parent or legal guardian) in your User Submission to use such person’s name and/or likeness.

(b) You grant to the YMCA a non-exclusive, world-wide, perpetual license, with the right to sublicense, to use, reproduce, copy, publish, advertise, display, post, transmit, modify, adapt and otherwise exploit the User Submissions, and your name and/or likeness as contained in your User Submission, in whole or in part in any form or media or technology, including all YMCA promotions, advertising and marketing. All User Submissions may be posted on the Site for immediate public viewing. You expressly waive any moral rights and release to YMCA any claims under the Canadian Copyright Act (as amended from time to time) in and to the User Submissions.

(c) You agree that your User Submission does not contain any illegal, harassing, defamatory, abusive, libellous, deceptive, fraudulent or obscene content or use vulgar language.

(d) You agree that transmitting or posting any User Submissions on this Website makes such content accessible to the public and the YMCA will not be held liable for any copying, reproducing, use or exploitation by third parties. You agree that you shall have no recourse against the YMCA for any alleged or actual infringement of any proprietary right in User Submissions. If you are under the age of majority you must have permission from your parent or legal guardian to post any User Submissions on this Site. In the event it is discovered that a minor posted User Submissions without consent from a parent or legal guardian all such material will be immediately removed.

APPLICABLE LAWS
These Terms and Conditions shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of the Province of Ontario shall have exclusive jurisdiction over all disputes.
